Terms and Conditions

Last Updated: 10/16/2026

Welcome to BacktestingMax. By accessing or using our website and application (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, please do not use the Service. Please read the financial and risk disclaimers in Sections 3 to 5 carefully — they are important.

1. Eligibility and Acceptance

You must be at least 18 years old and have the legal capacity to enter into these Terms to use the Service. By using the Service, you represent that you meet these requirements and that you are not barred from using the Service under any applicable law, regulation, or sanctions program.

2. Description of the Service

BacktestingMax is a trading education and backtesting simulation platform. It allows you to replay historical market data, place simulated trades, journal your activity, and analyze hypothetical performance. The Service operates only on historical and simulated data. It is not a brokerage, exchange, or trading venue, it does not execute real orders, and no real money is ever traded through the Service.

3. No Financial Advice

Nothing provided through the Service constitutes financial, investment, trading, tax, legal, or other professional advice, and nothing should be relied upon as such. BacktestingMax is not a broker-dealer, investment adviser, financial institution, or fiduciary, and we do not recommend or endorse any security, instrument, strategy, or transaction. All content, market data, scores, AI-generated output, challenges, and other features are provided for informational and educational purposes only. You are solely responsible for your own trading and investment decisions, and you should consult a licensed professional before making any financial decision.

4. Risk Disclosure and Hypothetical Performance

Trading foreign exchange, cryptocurrencies, commodities, indices, equities, and other financial instruments carries a significant risk of loss and is not suitable for everyone. You may lose some or all of your capital, and you should not trade with money you cannot afford to lose.

All trades placed within BacktestingMax are simulated and do not involve real money, real orders, or live market execution. Backtested and simulated results are hypothetical and are generated with the benefit of hindsight. They have inherent limitations and do not reflect real trading conditions such as liquidity, slippage, latency, fees, or the financial and emotional pressures of live trading. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown. Past performance — including backtested results — does not guarantee or indicate future results.

5. Market Data and Accuracy

Market and historical data are provided on an "as is" basis and may be delayed, incomplete, inaccurate, or contain errors. Such data may be obtained from third-party sources. The Service is not intended for live trading or order execution, and you must not rely on it as the sole basis for any real-world trading or investment decision.

6. Accounts and User Responsibilities

6.1 Account Registration

To use the Service you must create an account. You are responsible for providing accurate information, for keeping your login credentials secure, and for all activity that occurs under your account. Accounts are personal to you and may not be shared, sold, or transferred.

6.2 Acceptable Use

You agree not to use the Service for any illegal activity, fraud, or any conduct that violates these Terms or our policies. In particular, you agree not to: reverse engineer, decompile, copy, or create derivative works from the Service or its software; scrape, harvest, or extract data through automated means; resell, redistribute, or sublicense the Service or its data; circumvent plan limits, paywalls, or usage restrictions; share account credentials; or attempt to disrupt, overload, or gain unauthorized access to the Service or its systems.

6.3 Custom Scripts

If you use custom indicator scripting features, you are solely responsible for any code you create and run, and you use these features at your own risk. You must not use scripting to introduce malicious code, exfiltrate data, infringe third-party rights, or disrupt the Service or other users.

7. Subscription and Payments

7.1 Billing

Paid plans are billed either as a recurring subscription (monthly or yearly) or as a one-time payment (for example, lifetime access), depending on the plan you select. Prices can differ by country and are shown before you pay. By purchasing a recurring plan, you authorize us and our payment provider to automatically charge your selected payment method each billing cycle until you cancel. Payments are processed by our third-party payment provider (Paddle, acting as Merchant of Record; Stripe for certain legacy subscribers).

7.2 Cancellation

You can cancel your subscription at any time in the app under Account, then Billing, then "Cancel subscription". Once canceled, you will continue to have access until the end of your current billing cycle; please process your cancellation at least 24 hours before it renews to avoid further charges. A free trial is the exception: cancelling it ends it straight away (Section 7.3).

7.3 Free Trials

Some plans may be offered with a free trial. The length of the trial, the plan, and the price you will pay after it are shown before you start. A free trial is available once per account and only to accounts that have never had a paid plan or a trial. You need to add a payment method to start it. Before checkout we ask you to confirm that the paid plan starts as soon as the trial ends and is not refundable after that.

When the trial ends, your payment method is charged the price shown when you started (for example, one year of Premium), and the subscription then renews as described in Section 7.1 until you cancel. When the trial starts we email you the date and amount of the first payment, and we send a reminder about one day before the trial ends.

You can cancel during the trial at any time under Account, then Billing, then "Cancel subscription". Cancelling a trial ends it and your access to the paid plan immediately, and you will not be charged. We may refuse or end a trial where we see abuse, such as several accounts used to get repeated trials.

7.4 Refunds

Except where required by law, all payments are non-refundable, including in cases of billing errors such as accidental double payments where a refund is appropriate. Refund requests are reviewed on a case-by-case basis at our sole discretion. A free trial is the way to try a plan before paying, so a payment taken because a trial was not cancelled in time is not refunded, except where the law requires it. Refunds are not given where we or our payment provider see refund abuse.

7.5 EU Consumer Withdrawal Rights

If you are a consumer in the European Union, you may have a statutory right to withdraw from a purchase within 14 days. Because the Service provides digital content and services with immediate access, you may be asked to acknowledge that, by starting to use the Service during this period, you agree that this right of withdrawal is lost once performance has begun. If you start with a free trial, the right of withdrawal applies once, from the start of the trial, and you can use it by cancelling the trial before it ends. By starting a trial you expressly agree that the paid plan starts as soon as the trial ends, and you acknowledge that your right of withdrawal ends at that point. This Section does not limit any mandatory consumer-protection rights you have under Polish or EU law, or any rights our payment provider gives you under its own terms.

7.6 Price Changes

We may change our prices and plan features from time to time. Any price change to a recurring subscription will apply from the next billing cycle, and where required by law we will give you advance notice.

7.7 Invoices

You may request invoices or billing-related information by contacting us at support@backtestingmax.com.

7.8 Payment Failure and Past-Due Status

If a scheduled payment fails, your premium features will be immediately suspended and your account will revert to the free version. This does not by itself constitute a cancellation of your subscription or termination of this agreement. Subscription fees will continue to accrue as a past-due balance until the subscription is formally canceled by you as described in Section 7.2 or until BacktestingMax terminates the account. Successful future payments may first be applied to any outstanding balance.

8. User Content

The Service may let you create, save, and share content such as sessions, strategies, journal entries, screenshots, and entries in public strategies, battles, or leaderboards ("User Content"). You retain ownership of your User Content. By submitting or sharing it, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content as needed to operate and provide the relevant features. You are responsible for your User Content and represent that you have the rights to share it and that it does not infringe any third-party rights or applicable law. We may remove or restrict any content at our discretion.

9. AI Features

The Service may include AI-generated analysis, scores, critiques, and suggestions (for example, the AI Analyst). These outputs are automated, may be inaccurate, incomplete, or misleading, and are provided for informational and educational purposes only. They do not constitute financial advice and must not be relied upon as such.

10. Intellectual Property

The Service, including its software, design, text, graphics, and trademarks, is owned by BacktestingMax or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms. The Service may include third-party components that remain the property of their respective owners. All rights not expressly granted are reserved.

Names and logos of companies, funds, indices, exchanges, and cryptocurrencies shown in the Service belong to their respective owners. We use them only to identify the instruments the Service covers. Their use does not mean that any of those owners is affiliated with, sponsors, or endorses BacktestingMax.

11. Third-Party Links and Affiliate Relationships

The Service may contain links to, or promotions of, third-party products and services, including brokers and partner or affiliate programs. We may receive referral fees or commissions from these relationships. Such third parties are independent, and we do not control and are not responsible for their products, services, or content. A link or promotion does not constitute an endorsement. Any dealings you have with a third party are solely between you and that third party.

12. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or that any data or results will be accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

13. Limitation of Liability

To the fullest extent permitted by law, BacktestingMax and its operators, owners, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any trading or investment losses, lost profits, lost data, or loss of goodwill, arising out of or relating to your use of, or inability to use, the Service — even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service shall not exceed the greater of the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or fifty euros (€50). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection rights under Polish and EU law.

14. Indemnification

You agree to indemnify and hold harmless BacktestingMax and its operators, owners, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, your violation of these Terms, or your violation of any law or third-party right.

15. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may stop using the Service at any time and may delete your account from your account settings. Upon account deletion, your account and associated personal data are removed as described in our Privacy Policy. Provisions that by their nature should survive termination (including Sections 3 to 5 and 10 to 14) will survive.

16. Modifications to the Service and Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; when we make material changes we will update the "Last Updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict-of-laws rules. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms shall be the competent court having jurisdiction over the registered seat of BacktestingMax in Poland. This does not deprive you of any protection afforded by mandatory provisions of the consumer-protection law of your country of residence.

18. General

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and BacktestingMax regarding the Service. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for any failure or delay caused by events beyond our reasonable control.
